    Default Boss Didn't Pay Me

    So I find this job as a sales rep for a web site design company about 2.5 months ago. Its basically all cold-calling, but the incentive is I get half of the $2000 per website. A few weeks in and I make my first sale, boss says good job all that shite, and says I'll get paid in a week or two when the client has paid in full. This was at like the end of September.

    Got another sale a few weeks later, still hadn't been paid for the first one. (Probably my first mistake) I bring it up with the boss, he gives me all this bull about bank transfer issues. Every week its "the bank says the transfer has gone through, etc." but I kept sending him my account statements showing I never received funds.

    Last week or so I started being more aggressive, demanding that I get paid by this day etc. only to be followed by more bullshit. I got an email from him this morning saying "this is 7 days notice. I'm still working on the bank transfer issues." WTF.

    Thoughts on what I should do? I'm considering contacting his clients and telling them he doesn't live up to his word etc etc. Too bad I don't know his address.

    P.S. I'm in Australia, and coming back to the US in a week.

    Keep track of all correspondence with him, including past correspondence about being paid: time and nature of conversation. Do you have anything about the original agreement with him in writing? And if you need to sue him you'll want to do it in small claims court. A lawyer is going to be too expensive for a $2k dispute. Also, there is some sort of labor department/board in your state, file a claim with them. They can also probably tell you what to do.... and I imagine they take this kind of thing pretty seriously.

    DO NOT START CALLING HIS CLIENTS, or do any other sort of payback shit. That is just going to make it more difficult for you to get your money.

    Ok sorry found this thread late. I have had to deal with this twice already in my lifetime. You do not need a lawyer for this. Save yourself some money. Go straight to department of Labor in your state and file a claim against them it is just a piece of paper you file out. You can also pull this down from the internet and fill it out and send it to them. Trust me your employer will work to get that ish fixed will quick when the department of labor gets behind their azz. Make sure you have a paper trail of all the contacts you made with your employer to get the issue fixed and also of the hours not paid/ clock in time sheets and so on. That you can send over to the department of labor.

    Ok sick thanks. If I was in the states I would have already gone to small claims court, but I figured since I'm not I'd ask for the legal services of SOMB.


    Edit: I did sign a contract, and have kept all email correspondences.

    I actually take back what I said about not contacting a lawyer, and having to do small claims. To be honest I'm not really sure what approach would be best if you needed to sue. But I would def contact Department of Labor first and file a claim with them. Sounds like they can investigate on your behalf, and my bet is if he got a call of inquiry from them your boss would get his shit together real fast.

    Depends how much work he had to do to make the sales. If he only called spent a few hours a week doing that as a part time job it isn't bad

    haha, yes, it is super old. Which is why I didn't just say "do a barrel roll", I rephrased it. The classics never die, you just have to dress them up a bit.
