Default Reckless Driving - 21 over

76 in a 55. Spare me the lectures, just tell me what you recommend. I've currently got +2 good driver points (not sure if other states are the same as VA), the reason it's not higher is I've got a couple prior HOV tickets, but don't have any speeding tickets on record. Should I take a safe driving class? Wait and offer to take it when in front of the judge? Anything to help me get it lowered 2 mph, if possible.

What's gotten into you lately, Whit? Speeding, urges to smoke cloves, name dropping band members...

i would just go into the class now. it will make the judge think you actually care how safe you drive and he/she will probably let you off

    ew that sux.

Do you guys have the ticket fighting lawyer guys in VA? I know that state is a bit different.

    I would consider that option.

Oh and radar detectors are illegal in VA so the first person that says 'get a radar detector' gets negged

    here's the thing
the class gives you +5 points I think. In VA you can have a max of +5 points. A reckless driving ticket will take off -6 points. So, if I take the class now, i can only get 3 out of the 5 points (since I already have +2) and have the max, +5. Then, i'll get -6 which will leave me w/ -1 point. OR, if I wait till after I have the ticket, I'll have my current 2 minus 6, leaving me -4, then i'll get the full +5 which will leave me with +1 point.

Dale, a guy I work w/ said he had a similar sitch (81 in a 60), and just went to court without a lawyer. He said lawyer fees were ridiculous, and usually only got the tickets reduced. He had to pay like $250 fine and his insurance only went up a tiny bit. And his was worse b/c it was over 80. Another guy also told me it didn't really boost his insurance much. My insurance is pretty low right now, an extra $10-30 a month wouldn't bother me much. I really don't want to have to pay a bunch of lawyer fees before my Disney trip coming up.

i have court next friday regarding a speeding ticket and i took the safe driving class beforehand to erase all the the points. ill let you know how it goes after i go to court and tell ya what the judge says. thats all i did though. a lot of people get their speedometer calibrated so that you could say faulty equipment and he might knock the speed down some.

Shit the fine + court costs for that in CA = new carbon board.

Having points is a bad thing here, not sure how that affects your decision. Here I would take the driver's class online. You may however want to show up in court, plead no contest and ask the judge if they can lower the fine and/or lower the charge to just speeding.

Take responsibility up front but also throw in an excuse while not using it as an excuse (if you know what I mean) your lack of speeding history will help.

How much were the HOV tickets? Out here they are over $500.

first one was like 100, the second one was like 200, third was 500+. I know, I'm an idiot. I have a 40 min drive home from work every day and it's hard to watch people breeze by on the HOV while you're sitting in traffic.

I'm not sure how far back they span but they are spread out a lot. I'm thinking the first one was like 2003 or 2004.

I kind of thought of just going in there and being like "honestly I am usually very careful about my speed, I had just left the ocean and there were no other cars on the road and I just kind of lost track of my speed for a moment. I would hope that given my clean prior record with regards to speeding that _________________<something about lowering the ticket>__________________. I would be more than happy to take a safe driving class if that would help."

something like that. The cop asked me when he pulled me why I was speeding and I was like "I don't know, I just got out of the ocean, sometimes my driving is a little off for the first couple of miles" Which is true but sounds like BS. The court date is Oct 16th, I haven't really put any thought into it yet. The big blank is what I'm wondering about. Like what do you say besides "come on man, it's 2mph."

I would go ahead and take the class but I don't want to show up and have the judge just be like "oh well" and not care about the driving class, and here I've spent X amount of dollars and time on a class I could have waited to take until afterwards, which would have resulted in an extra 2 good driver points on my license (see my math above if you don't know what I mean). Plus i'm thinking if he sees my record and already is considering maybe lowering it, "sweetening the deal" by saying I'll take a driver class may tip him over.

well i'll let ya know how the class thing turns out for me. i was told by a few people to go ahead and take the class beforehand, but then again the class also erased all my points for me and didnt leave me with any left over.

    they just want your money.

what they do here in jerz is this:

2 pt ticket will be erased (the 2 pts) for 450 bucks
4 pt ticket will be reduced to 2 pts for 450 bucks.

these are DMV pts. insurance/dmv/cops(basically) judge you on how many pts you have

reckless i think is 5, and 12 would result in a suspended license.

really useless information for the fact that each state is SO different, but ive got the system here down pretty pat. usually the prosecuter talks to you first to see if you wanna pay the big bucks and get in reduced or face the judge on your own

I will face the judge on my own. I'm in a position to absorb slightly higher insurance costs but not really in a position to shell out big bucks on that date, beyond the price of the ticket.

I used to put a hooded sweatshirt on a basketball, no lie. I would say my rate of taking the HOV to actually getting caught is at least 50:1.

It takes some getting used to driving in the HOV lane since sometimes you're doing 60 and lane next to you is doing 0.

haha yeah. Here it's a separate 2 lane road in between the 2 beltways that switches direction in the middle of the day. Once you get on it's 7 miles till you can get off, except for 2 breaks in the dividers for cops. A couple of times I have taken those when I was running late and wasn't in the HOV, although I'm sure i'd get in REALLY big trouble if I was caught doing that. That's rare though. But yeah, once you're in, you're committed. WHat i do is, if I pass a cop that has somebody pulled over, I drive the speed limit past him, then once I'm out of range I gun it, and just book it as long as I can, just in case he's just finishing up w/ that person and would be rolling out.

Yeah here it's just the left lane of a regular 4 lane freeway so you can hop in and out. I hate when the cheaters sneak out - they're all paranoid, looking for a space to turn into if they see a cop. Slows my ass down. It's fun to tailgate them and lean on the horn, hoping a cop is around.

I don't mind the cheaters, just the slow ones.

edit: committing to 7 miles takes stones!

I've been in this situation plenty of times because I have a lead foot. Anyways...
1: Show up to court in a suit if possible, looking professional, believe me it matters.
2: Bring your driving record from DMV, it helps a lot especially if it's clean. I don't think anyone is going to care about your HOV tickets.
3: Show remorse, even though it's a facade. I wouldn't bother with excuses, I mean a judge has heard every flavor of bullshit before, the only one that impresses them is remorse.
4: You can most likely find an auto shop that will say your speedometer was off 3 MPH if you try. I got 9 MPH knocked off mine one time and it possibly saved me some jail time.
5: If you get fracked in traffic court you can go to traffic appeals court where the judges are way less strict for a second chance. I got a bad Reckless 4 years ago, pulled up with said 9MPH speedometer off bullshit, judge gave me 6 months suspended and a $500 fine (or something like that). Went to appeals, got regular speeding and a $200 or so fine.

Edit: Also you are an idiot for taking the HOV on 64 West in the morning, I drive from the Oceanfront to Tidewater Dr. every day and there is always at least 2 cops on there, and frack it why not, it's like free ticket quota in record time.

does bringing your driving record help? i have court next week with a 41 in a 25. my record's spotless, no accidents or tickets or anything. i just figured the court would have a copy of that on hand. i was gonna get one from DMV but i didnt feel like paying the money for it.

Did you get a speeding and a reckless? Does the ticket indicate a mandatory court appearance?

I would _not_ go to court on your own. VA loves their traffic citations.

If you can just nuke it with traffic school, I'd do that, but like in FL, I don't think a reckless can be schooled without a court appearance (and accordance by the judge).

$100 bucks and they send a lawyer in your place. I've had multiple BAD speeding tickets that have been completely dropped. Instead of paying over $400 for the ticket, and getting god knows how many points on my license, all I had was the $100 lawyer cost
